Notification of Copyright Infringement
Prachi Art Studio respects the intellectual property rights of others and expects its users to do the same.
It is Prachi Art Studio's policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.
In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Prachi Art Studio will respond expeditiously to claims of copyright infringement committed using the Prachi Art Studio website that are reported to Prachi Art Studio's email address.
DMCA Notice of Alleged Infringement ("Notice")
Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
Identify (i) the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Site where such material may be found, and (ii) the reference or link, to the material or activity that you claim to be infringing, that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate that reference or link, including at a minimum, if applicable, the URL of the link shown on the Site where such reference or link may be found.
Provide your mailing address, telephone number, and, if available, email address.
Include both of the following statements in the body of the Notice:
"I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference or link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
"I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
INTELLECTUAL PROPERTY RIGHTS
5.1. All content included on the Site such as text, images, graphics, button icons, images, audio clips, databases, software, and names, images, and logos or marks identifying StateoftheART and/or any third party is the property of PAS or its content suppliers and protected by Canadian and international copyright laws. Furthermore, the compilation (meaning the collection, arrangement, and assembly) of all content on the Site is the exclusive property of PAS and is protected by Canada and international copyright laws. The Artists represented on the Site have granted a licence to prachiartstudio.com for all images uploaded to be available for use in support of marketing and promoting the Site. PAS hereby grants you permission to electronically copy and print portions of the Site for the sole purpose of placing an order for a Work with prachiartstudio.com. Unless otherwise explicitly stated by PAS, the copyright of any Works remains with the originating artist.
5.2. All Works are owned solely by the relevant Artists and are subject to Canadian and international copyright laws. The Artist warrants that he has the title to and owns the Works represented to be owned by him on the Site.
5.3. The sale of the copyright in a Work is a separate transaction and not part of the sale of the Work unless otherwise agreed in writing between yourself and the Artist.
5.4. Any misuse of the content on the Site, including without limitation, reproduction for purposes other than those specified in 5.1 above, modification, distribution or republication of any part of such materials without the prior written permission of PAS, is strictly prohibited.
5.5. Nothing contained in these Terms and Conditions shall be construed as conferring upon you, expressly or by implication, any licence or right to use any trademark, patent, design right or copyright owned by PAS, the Artist or any third party.
